Summary of PATRIOTIC DREAM A TRULY DEMOCRATIC AMERICA by Sam Carr Polk
1. Why a NEW U.S. CONSTITUTION is overdue BRIBERY from campaign contributions must be ended; SEPARATION OF POWERS and CHECKS AND BALANCES are no longer needed; specialized groups of Ombudsman-like GUARDIANS can replace them; a COMPUTER IN CONGRESS can bring equal representation; JUDICIAL REVIEW can be limited and the FILIBUSTER abolished; five historic FAILURES of the Constitution can be reviewed; its worst structural failure can be reversed TWO SENATORS PER STATE.
2. An unofficial ADOPTION METHOD is possible a joint project of many PROGRESSIVE ACTION ORGS could name a group of experts to DRAFT a proposed new national charter and educate voters to understand and consent to it with a super-majority in an (unofficial) RATIFICATION ELECTION when polls show it will win. LEGALITY involves a sole U.S. SUPREME COURT DECISION and five from STATE SUPREME COURTS, plus the FOUNDERS' PRECEDENTS.
3. STRENGTH and UNITY can be achieved by UNIFYING CONGRESS into one body with two kinds of members DISTRICT MEMBERS and SENATORS; letting the “CHIEF” (CEO) be elected by Congress instead of us too-easily-fooled voters; limiting JUDICIAL REVIEW; and even considering possible POLITICAL UNIFICATION if all state people were treated fairly.
4. EQUAL REPRESENTATION of every voter by district members achieved by having TWO WINNERS ELECTED FROM EACH DISTRICT, but in Congress they would vote by WEIGHTED VOTING based on votes received, rather than one vote each. HONEST ELECTIONS would be guaranteed, by public funding and even subsidies to the PARTIES for a return to nomination by conventions with the END OF PRIMARIES. Campaigns would become friendly and cheap, and an END TO GERRYMANDERING of district lines would be a valuable by-product!
5. SENATORS could be elected by ADJUSTABLE PROPORTIONAL REPRESENTATION, with a nationwide two-choice vote for “MAJORITY PARTY” as the basis for transfer of the voting entitlement of all members of all other parties as necessary to give the MP a WORKING MAJORITY of 54-56% or so. That would end PARTISAN STALEMATES in Congress.
6. COMPUTERIZING CONGRESS would help to achieve real majority rule by allowing quick record voting on all questions, making RULES COMMITTEES and even COMMITTEE “KILL” POWER unnecessary, and speeding CONSENSUS-FINDING by multiple-choice voting on all bills introduced to solve a given problem, and MEMBER FEEDBACK during debate.
7. SAFETY FROM ABUSES could be better obtained from several specialized groups of Ombudsman-like “GUARDIANS,” instead of the founders' “CHECKS AND BALANCES.” They would be first named by the drafting body, to be ratified by the voters, and their independence from Congress could be guaranteed by their “FORMULA BUDGET” and cooption of member replacements. Their COUNCIL would be presided over by a charismatic “PRESIDENT” who could relieve the CHIEF of wasting time over “ribbon-cutting” rituals. Most vital would be the group of “POLITICAL GUARDIANS,” who would govern all aspects of elections and parties, and even adopt rules for the lawmaking procedures of Congress. A possible way to reduce election costs and the impossible burden on us voters would be to have them take nationwide polls every two months or so to see if the Majority Party is still favored by a majority, and if not, to call a new election in three months or so. That would replace terms of office for Congress, and might even be extended to triggering individual elections of district members.
8. A BETTER BILL OF RIGHTS? Only the Third Amendment on quartering troops is out-of-date, and the others could be improved by applying the insights of the dissenting minorities of the Supreme Court and lower courts to clarify and modernize their meaning, and thus discourage litigation. Some economic rights such as FDR named in his “2nd BILL OF RIGHTS” in 1944 might be added, to give birth to a vital new freedom “FREEDOM FROM POVERTY"!
